Suing Your HMO Just Got Harder

The Supreme Court ruled that some patients whose Health Maintenance Organizations (HMOs) refuse to pay for recommended care cannot use state law to sue their health insurance companies. Many Americans have health insurance through employer plans governed by the 1974 Employee Retirement Income Security Act (ERISA) and, according to the justices, ERISA bars patients from seeking damages in state court for the denial of proper medical care.
